Breaking UK Immigration News
The Home Office has issued its new guidance in respect of Covid-19. The Home Office had previously made a number of concessions that run until the end of May 2020.
The Home Office have now issued new guidance on 29 May 2020 which contains a number of key changes and continues some previous concessions.
In short, the Home Office:
Firstly, extended the scheme whereby if your visa was due to expire between 24 January 2020 and 31 May 2020 and you could not leave you could apply for free to extend your visa – this has now been extended until 31 July 2020.
However, you will need to make an application for this to apply if you visa runs out after 31 May 2020 – if you previously applied to extend your visa it will be automatically extended.
Secondly, the government has continued the practice of allowing individuals to make applications in country where they would normally need to go home, ie you can switch from visit visa to spouse visa without the need to return home.
Thirdly, the HO have in respect of Tier 1 Entrepreneur Migrants are allowing individuals to add up various months of employment and jobs rather than a continuous period of 2 people for 12 months.
Fourthly, and most interestingly, if you are a student and have applied for a Tier 4 visa you can start your course, subject to certain conditions even if you have not got a decision from the Home Office.
Fifthly, the Home Office are also allowing Tier 2 and Tier 5 applicants to start work if they have made their application but not received a decision again subject to certain requirements which I have set out in the video and are expanded upon on the government’s website.
Lastly, the NHS, the HO are continuing their policy of granting an automatic extension for various people who work in key work in the health care sector – a complete list is on the government website and my own blog at www.theimmigrationbarrister.co.uk and any time limits on the hours of those working or volunteering for the NHS are lifted.
