There are some very important changes issued by the Home Office today, relating to visa extensions to those who could not go home – the Home Office will not be extending them any more.
It is vital that you take action – and I set out below what the changes are and what you need to do.
If you’re in the UK and your leave expired between 24 January 2020 and 31 July 2020 and extended your visa – you will not be able to extend it again as the government thinks it safe for people to leave given travel restrictions being lifted.
The government has announced it will give people a grace period to arrange departure by 31 August 2020 and leave will be extended, during this period you will retain any rights you had before, ie the right to work etc.
However, and this is a big warning for those who do not want their leave broken if you intend to leave the UK but are not able to do so by 31 August 2020, you may request additional time to stay, also known as ‘exceptional indemnity’, by contacting the coronavirus immigration team (CIT).
The indemnity does not grant you leave but will act as a short-term protection against any adverse action or consequences after your leave has expired.
The Coronavirus Immigration Team will provide you with further advice on what you need to do to request an indemnity, such as providing evidence of a ticket etc.
The other concessions regarding NHS staff and work are continuing at present – please see my previous videos for full details.
However, the government has now called time on extending leave and you must act to avoid becoming an overstayer – as this will expose you to the hostile environment, loss of work rights, and potential detention and removal.
I cannot stress enough that if you want to stay in the UK you must make an application before your leave expires.
There is some good news in that if you did not apply to extend your visa until 31 July and are an overstayer you can make an application without being penalised as long you make the application now or after 1 August 2020.
If you have any queries or want to make an application please contact me at Imperium Chambers and we can arrange to help.
