Around four years back, the Home Office used a blanket policy whereby they revoked the applications of all the students whether they had cheated in the TOEIC (Test of English for International Communication) or not, and the Home Office started to cancel everyone’s visas.
Then last year it was challenged, and the Home Office started to give right of appeal to all the applicants who had been affected. When any appeal was granted, the Home Office would give them a Visa of 60 days so as to put them in the same state of affairs as they were before the revokement.
Let’s take an example, when a student was given a Visa, he could get a CAS (Confirmation of Acceptance for Studies) Letter and continue his studies. The problem with this judgement was that when someone’s visa was cancelled four years back and he had not been pursuing the education anymore, no university would grant them a CAS Letter, and also since he was not permitted to work, how could he pay the tuition fees?
Now, in 2020, the upper tribunal has passed a judgement that whoever’s TOEIC appeal has been granted, they should get a visa of 2.5 years. This is a very good news especially for those who could not obtain a CAS Letter in the six months time period, now they can challenge and submit an application that they should be given a visa of 2.5 years in the light of the new judgement.
For an example, if your appeal was allowed last year and you were given a visa of 60 days, and you could not get a CAS Letter from the university, now you can appeal again and submit application for 2.5 year visa.
So now it has never been a better time to appeal for visa extension, if you fall under the TOEIC cases.
